SUFFOLK COUNTY HIGHWAY PATROL BACK ON THE LIE

On Wednesday November 21, 2012 the Suffolk Highway patrol began patrolling the Long Island Expressway. The LIE in Islandia ( around exit 58 ) had been patrolled by the Suffolk County Sheriffs Department, with the Suffolk County Police issuing tickets on the service road of the LIE in Islandia. I would expect there to be an increase in the amount of traffic tickets being issued with the Suffolk County Highway Patrol covering this section of the LIE.

ISLANDIA VILLAGE COURT OFTEN DOES NOT PERMIT GUILTY PLEA BY MAIL

The court does not permit defendants to plead guilty by mail to speeding tickets 21 mph over the speed limit or more. These are 6 point violations. The court is requiring that either you, or an attorney to appear in court on these speeding tickets. If you retain an attorney, you will not have to appear yourself. In fact I have always been able to resolve these tickets without my clients ever having to go to court.

COURT ADDS ANOTHER COURT SESSION

Because of the large number of tickets being sent to the Islandia Justice Court, the court has added a new court session on Thursday mornings. So if you are an attorney, don’t assume that your case is on for the afternoon, as the court is scheduling a lot of cases in the morning now.

The Islandia Village Court is vacating pleas on cases where defendants are ordered to complete a defensive driving course and failed to provide proof of completion by the date ordered by the court. Tip, if the court orders you to complete a defensive driving course, make sure you provide proof of completion by the due date, otherwise the court will issue a violation of a conditional discharge and reschedule the case back on the court calendar.

ISLANDIS COURT VACATING PLEAS FOR FAILURE TO PAY FINES

Instead of just imposing fines as part of the sentence, the court has started to issue fines as part of a conditional discharge. This change has meant that when defendants fail to pay their fines, the court is issuing a violation of a conditional discharge and placing the case back on the calendar. All courts handle their cases differently. With Islandia tickets, it is really important to pay the fines and surcharges on time, or you are going to be hauled back into court. In many cases the dispositions are being vacated ( undone ) when the fines have not been paid on time.

NEW PROSECUTOR

A new change to the Islandia Village court is that the Suffolk County District Attorneys Office has assigned one prosecutor to handle the majority of the west end local Village courts in Suffolk County. In the past, the assistant district attorneys assigned to the First District Court in Central Islip would be sent to the Islandia court on a rotating basis to prosecute the Islandia tickets. Now one prosecutor is assigned to prosecute the tickets every Thursday.
