Suspended License
In New York, there are a number of different types of tickets you can receive for driving without a license, driving with a suspended license or driving with a revoked license:
- VTL 509.1 Driving without a license
- Operating a vehicle without a license (VTL 509.1) is a traffic infraction, not a misdemeanor. Even though it is not a crime, the court can still impose a sentence of jail. In fact, in a number of courts throughout Long Island defendants appearing, usually pro se, are remanded and placed in custody for this offence.
- VTL 511.1a Aggravated unlicensed operation in the 3rd degree.
- Aggravated unlicensed operation of a motor vehicle in the 3rd degree ( VTL511.1a) is a misdemeanor. A conviction to this offense will result in a criminal record unless you under 19 years old when you received the ticket and are granted youthful offender status by the court.
- VTL 511.2a Aggravated unlicensed operation in the 2nd degree.
- Aggravated unlicensed operation in the 2nd degree ( VTL 511.2a) is also a misdemeanor. It is a more serious offense than a 511.1a. A conviction to VTL 511.2a by law requires a mandatory sentence of either jail and/or probation as well as a minimum $500 fine plus a surcharge.
- 511.3 Aggravated unlicensed operation in the 1st degree.
Unlicensed Operation in the 1st Degree is a felony offense. It is punishable by prison of up to 4 years or 5 years probation or a combination of up to 6 months jail and 5 years probation and a mandatory fine of $500.00 to $5,000.00. If the case is pursued on a felony level, the case will end up at the First District Court in Central Islip. Upon indictment, all felony cases in Suffolk County are transferred to the County Court in Riverhead.
